1. 피고인들의 공동범행 피고인들은 일행으로서 2016. 3. 31. 22:45경 경남 창녕군 E에 있는 F 앞 노상에서 G와 시비를 하였고, 폭행사건 신고를 받고 출동한 H파출소 소속 경위 I, 경사 J 등이 위 G에게 사건경위를 물어보고 피고인들에게 집으로 귀가할 것을 요구하였으나, 피고인 A, C가 싸우기 위해 G에게 달려들었고, 이에 위 I이 피고인 A를 손으로 제지하면서 말리자 피고인 A가 오른발로 위 I의 다리를 2회 찼고, 피고인 B은 피고인 A가 위 행위로 위 I에 의해 공무집행방해죄의 현행범으로 체포되자 위 I에게 달려들어 주먹으로 등을 2회 때려 위 I이 A를 제압하지 못하도록 하였고, 피고인 A는 체포상태에서 풀려나자 주먹으로 위 I의 얼굴을 향해 주먹을 3회 휘두르고, 두 발로 허벅지 부위를 5회 가량 찼으며, 위 J이 위와 같이 달려드는 피고인 C를 말리자 피고인 C는 두 손으로 위 J의 멱살을 잡아 수회 흔들어 착용하고 있던 넥타이를 찢어지게 하고, 손톱으로 위 J의 목 부위와 오른쪽 팔목 부위를 긁었다.
