Punishment of the crime

1. Defendant A is a person who operates K in the Nam-gu Incheon Metropolitan CityJ.

A person seeking to operate a construction business shall be registered with the Minister of Land, Transport and Maritime Affairs for each type of business prescribed by Presidential Decree;

A. The Defendant, without registering construction business with the competent authority, performed the “school fence construction work” from November 27, 2008 to December 26, 2008, and received KRW 20 million for the construction work cost.

B. The Defendant, without registering construction business with the competent authority from December 2, 2008 to December 11, 2008, received construction cost of KRW 1,094,000 for construction work without having registered the competent authority.

C. The Defendant, without registering construction business with the competent authority from April 21, 2009 to April 27, 2009, received construction cost of KRW 1,0560,000.

Accordingly, the Defendant carried on construction business from November 27, 2008 to April 27, 2009 without registration.

2. Defendant B is a person who operates “O” in Gangseo-gu Seoul Metropolitan Government N.

A person seeking to operate a construction business shall be registered with the Minister of Land, Transport and Maritime Affairs for each type of business prescribed by Presidential Decree;

A. The Defendant, without registering construction business with the competent authority from March 3, 2008 to March 12, 2008, received the construction cost of KRW 109 million from March 3, 2008.

B. The Defendant, without registering construction business with the competent authority from June 25, 2008 to July 5, 2008, received construction cost of KRW 1,324,000 for Q elementary school’s modernization of science rooms.

C. The Defendant, without registering construction business with the competent authority from August 4, 2008 to September 2, 2008, received construction cost of KRW 1,098,000,000 for the construction work cost.

The defendant shall not register his construction business with the competent authority from August 11, 2008 to August 25, 2008.
