A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a general secretary of the Victim F Association (hereinafter “Association”) from around January 13, 2014 to December 31, 2013, and a person who works for the Association managing director from around January 13, 2014 to January 13, 2015, while performing the duties of fund management, such as application for subsidies and budget execution.

1. On March 20, 2012, the Defendant: (a) received KRW 1,00,000,000 from the Gangwon-do Sports Association to the Agricultural Cooperative Account under the name of the Association as a gold for the “G Games” and the “H Games”; (b) around March 30, 2012, the Defendant paid KRW 1,170,000 using a physical card connected to the said account from the K Hotel located in Yangyang-gu, Yangwon-gun, Yangwon-gun, for the purpose of operating expenses of the Association; and (c) around that time, revoked the payment of KRW 285,00 for the operating expenses of the Association.

In addition, from around that time to July 27, 2014, the Defendant changed the amount of embezzlement No. 1 of the List of Offenses No. 1 of the annexed Crimes from around that time to around July 27, 2014, “1,000,000” to “285,000”, and the annual embezzlement amount “50,000” to “27,000”, and the combined embezzlement amount to “11,585,000” to “10,847,000” respectively.

The total amount of 10,847,000 won was embezzled by the same method over 25 times, such as the statement, for the purpose of operating expenses of the Association, according to its own mind.

2. Around December 22, 2011, the Defendant received KRW 9,295,00 from the Gangwon-do Office of Education to the Agricultural Cooperative Account (I) under the name of the Association as the payment for “L” subsidies, and kept in custody for the victim. On the same day, the Defendant revoked the payment of KRW 1,36,00 by using the physical card connected to the said account from N located in Gangseo-gun M in Gangwon-gun, Gangwon-do, and then consumed the same amount for the purpose of operating expenses of the Association.

In addition, from around that time to December 21, 2014, the Defendant changed the list of annexed crimes No. 2, No. 4, 13, 24, and 24.
