1. The Defendants jointly and severally pay to the Plaintiff KRW 101,629,980 and KRW 26,754,711 among them.
Reasons
On October 31, 1994, Defendant A received a loan of KRW 30 million from the new bank (hereinafter “new bank”) under the joint and several guarantee of Defendant B and C (hereinafter “new bank”) on October 31, 1999. The new bank transferred the above principal and interest of loan to the Plaintiff on June 28, 2013 and delegated the authority to notify the transfer. The Plaintiff notified the Defendant A of the transfer of the claim on June 23, 2014. The Plaintiff applied the interest rate of KRW 17% per annum, and the Plaintiff applied the interest rate of KRW 26,754,711, interest and interest interest rate of KRW 74,875,269 as of August 10, 2014 to the Plaintiff and the Defendant as of August 10, 2014, the Plaintiff and the entire pleadings pursuant to subparagraph 1-1, 2, 32, 32, and 4 of the Civil Procedure Act are not acknowledged as disputes among the Plaintiff and the Defendant C’s entire pleadings.
Defendant C asserts that he paid KRW 9,894,00 on four occasions from February 1998 to June 199, that the employees of the new financial information company would have paid KRW 1/30,00.
According to the statement of evidence Nos. 1 and 4-1 of the evidence Nos. 1, 346,00 won in total of 980 won in principal and interest 1,345,020 won in July 25, 1998 and interest 1,346,000 won in total, 510 won in principal and interest 2,202,490 won in December 18, 1998 and interest 2,203,000 won in total, 609 won in principal and interest 836,391 won in February 23, 1999 and interest 837,000 won in total, 836,391 won in principal and interest 837,000 won in total, and 1,507,980,008 won in June 7, 199.
However, except for the principal and interest extinguished by repayment as above, it is identical to the above fact prior to the above amount, and each of the above evidence alone is insufficient to recognize that a new bank exempted Defendant C from the remainder of the obligation, and there is no other evidence to acknowledge otherwise.
Therefore, the defendants jointly and severally do so to the plaintiff 101,629,980 won = principal 26,754,711 won until August 10, 2014.
