A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Around August 19, 2011, the defrauded suggested that the Defendant would operate a medical care hospital by investing H and 3 200 million won with the victim’s H and 3 200 million won from the G Council members operated by the Victim F in Sinsi-si, Sinsi-si, the Defendant made a false statement to the effect that the Defendant paid KRW 200 million to the Plaintiff the lease deposit for the building in Sinsan-si and J commercial building.
However, the defendant entered into a lease agreement with K, the main owner of the above commercial building, under the condition that he does not receive the deposit for lease, and even if he did not have the intent or ability to pay 200 million won as the victim stated, he did not notify the victim.
The Defendant received 50 million won from the victim to the new bank account in the name of the Defendant under the name of the same day, and 150 million won from the same account around the 31st of the same month.
Accordingly, the defendant was given property by deceiving the victim.
2. Although it was necessary for the Defendant to prepare a lease contract in the above F name, which is a doctor to register a business operator of a convalescent hospital to be newly established, the Defendant had the lessor and F wish to forgee the lease contract with the concern that 200 million won of the lease deposit was not paid if the lessor and F met, with the intent to forge the lease contract. On September 201, 201, at the office of the M Licensed Real Estate Agent's Office located in Ansan-gu, Ansan-si, Seocho-si, the Defendant used the computer as the part of the Defendant left by using the computer, “this KRW, 200,000,000,” “on September 15, 201,” “on September 14, 2016,” “on September 14, 2016” in the balance payment date: “on August 30, 2011,” and “on the date of preparation of the contract: The above name and address of the lessor, name and address in Gyeonggi-do.”
