Reasons
Punishment of the crime
On November 22, 2018, the Defendant entered into a contract to purchase all pine trees within nine parcels (283,437 square meters in total) (283,437 square meters), such as Gowon-gun E Forest and E, which are owned by D, for KRW 600,000,000, and to purchase KRW 30,000,000,000,000,000,000 won in the Hanwon-gun, which is the kind C owned by D., for purchasing KRW 30,000.
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Forest): (a) the Defendant, without permission, intended to cut pine trees from the forests and fields not included in the subject matter of the above tree sale contract; (b) from November 26, 2018 to December 3, 2018, in order to perform the extraction work of pine trees pursuant to the above tree sale and purchase contract on the high-gun G Forest and H Forest and fields not included in the subject matter of the said tree; and (c) the number of the relevant forest and fields can be known with the GPS equipment owned by the Defendant at the time of extracting the human body and cell phone satellite photographs; and (d) even though the Defendant clearly known the boundary thereof, 2 shotfys of pine trees worth KRW 75 to 97cc in total at the market price of the victim of the said forest and fields in Sung-gun-gun, and 300,700,0000,0000,000 bar bar bar bar work (hereinafter referred to as 37,707,07,000).
Accordingly, the defendant stolen forest products with the originating price of not less than 10 million won and less than 100 million won, which are owned by the victims in forests.
2. A person who intends to cut standing timber or extract or gather forest products in a forest violating the Creation and Management of Forest Resources Act shall obtain permission from the competent authority, as prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs;
Nevertheless, the defendant has jurisdiction.
