A defendant shall be punished by imprisonment for not more than ten months.

Of the facts charged in the instant case, damage to property by occupational negligence is caused.

Punishment of the crime

On June 23, 2004, the Defendant was sentenced to a fine of three million won for a violation of the Road Traffic Act (driving) at the Ulsan District Court on June 23, 2004; on August 2, 2004, the Defendant was sentenced to a fine of one million won for a violation of the Road Traffic Act (free license) at the Chuncheon District Court on August 2, 2004; on January 14, 2008, the same court was sentenced to a fine of three million won for a violation of the Road Traffic Act (on April 9, 2009), and was sentenced to a suspended sentence of ten months for the same offense at the same court on the same date; on June 28, 2011, the enforcement of the sentence was completed at the Seoul Detention District Court on June 13, 201, and was sentenced to a fine of four million won by the same court on August 25, 2011.

1. Around 19:05 on August 29, 2012, the Defendant: (a) drive a c presson vehicle with a blood alcohol content of about 0.243% at a section of about 50 meters from the direction of the CU convenience store located in the TU convenience of Gangwon-gun to the front of the instant police box located in the same Ri; (b) drive the said presson vehicle with a blood alcohol content of about 0.243% at the front of the said police box; (c) around 19:20 on the same day, at around 19:20, the Defendant driven the said presson vehicle while under the influence of alcohol concentration of about 0.243% at the front of the said c presson vehicle.

On August 29, 2012, the Defendant violated the Road Traffic Act (unlicensed Driving) around 18:55, the Defendant driven the said presses without obtaining a driver’s license, at a distance of about 10km from the front of the Defendant’s dwelling in the Gangwon-gun, Gangwon-do to the front of the said presses box via the CU convenience store located in the Hacheon-gun, Gangwon-do, Gangwon-do.

On March 16, 2013, at around 15:50 on March 16, 2013, the Defendant driven a C presson freight vehicle without a vehicle driver’s license from approximately 5 km section from the road near the vacant river in the Chuncheon-si, the C presson vehicle, to the front road of the C will be located in Chuncheon-si.
