Reasons
Punishment of the crime
1. Defendant A, with knowledge of the fact that the EMW car registered in the name of D was distributed in the name of the EM car, and the victim C, the final transferee, was occupied by the victim, the last transferee, and conspired in sequence with F and G in order to steals the said vehicle.
On July 1, 2016, at around 02:55, the Defendant: (a) moved the above F and G to H, Kimcheon-si, the injured party’s residence, Kimcheon-si; (b) reported the network within the above NNS car with F, and (c) opened a driver’s seat and opened it into the city in a manner that it is impossible to identify the injured party’s access to the BM car parked in the above MM parking lot.
The defendant stolen the above BMW car at the market price of KRW 16,100,000,000 in collaboration with F and G by the above method.
2. A person who takes over a registered motor vehicle shall file an application for the registration of transfer of ownership with the Mayor/Do Governor, as prescribed by Presidential Decree;
Nevertheless, the Defendant did not file an application for the registration of transfer of ownership of a motor vehicle within 15 days without justifiable grounds, even though he/she acquired the BMW motor vehicle registered in the name D from F in a place where it is impossible to know at the time of the border of April 11, 2016, at KRW 13 million.
3. A person who takes over a registered motor vehicle shall file an application for the registration of transfer of ownership with the Mayor/Do Governor, as prescribed by Presidential Decree;
Nevertheless, the Defendant did not apply for the registration of the transfer of the ownership of a motor vehicle within 15 days without justifiable grounds, even though he/she acquired from B the eMW car registered in D from the de facto distance in the Young-dong, Kimcheon-si, Kimcheon-si on May 11, 2016 to KRW 16.1 million.
