Punishment of the crime

The Defendant was a preliminary candidate for the 20th National Assembly member C Party D in the 20th National Assembly member C.

No one shall visit door to door for an election campaign or for the solicitation of admission during the election period.

Nevertheless, on March 4, 2016, the Defendant: (a) entered red folder stating “Preliminary Candidate A” at the F Gun Office located in E on March 4, 2016, and expressed this part of the facts charged to the public prosecutor’s office of the border area development branch office, such as the border area development unit, etc.; (b) inasmuch as the continuity of each unit is recognized, the Defendant’s visiting act of each office cannot be evaluated as a mere fact-finding; and (c) even after examining the record, it appears that the prosecutor’s opinion does not seem to be subject to prosecution as to visiting the office other than the above facts charged, and thus, it is deemed that only the visiting act of the office specified in the facts charged is the facts charged.
