A은 2019. 1. 27. 03:40경 대구 수성구 C에 있는 ‘D’ 식당 주차장 앞 도로에서 일행인 피고인 B이 그 옆을 걸어가던 피해자 E(27세)와 어깨를 부딪친 것을 이유로 시비를 하고 있는 것을 보고 화가 나 주먹으로 피해자의 얼굴을 1회 때리고, 피고인 B은 이에 가세하여 넘어진 피해자의 몸통을 수회 발로 걷어차고, 계속하여 피고인 A은 일어나서 바닥에 앉은 피해자의 얼굴을 주먹으로 수회 때리고 발로 몸통을 수회 걷어찼다.
