A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. Larceny;
A. At around 00:00 on June 4, 2014, the Defendant taken off one cell phone and credit card at the victim E’s waiting room located in Annyang-si C in Annyang-si, Annyang-si, where he worked in the Dondong-gu.
Accordingly, the defendant stolen the victim's property.
B. At around 18:00 on October 7, 2015, the Defendant sought a “G” for the operation of the Victim F, which is located in a luminous name name, so that the Defendant can work from the cater to the victim in a way that he can do so, and requested the victim to be employed from the cater so that he can do so, and the victim discovered a locking place by using the bucks of the cater, opened the locking room, put 30,000 won in his own bank, which is the cash owned by the victim, into his own bank, and kept it.
Accordingly, the defendant stolen the victim's property.
2. On June 4, 2014, the Defendant violated the Fraud and the Specialized Credit Finance Business Act: (a) committed as if he was a legitimate holder of the credit card under the name of the above E, which was stolen, as described in paragraph (1) at Ansan-si, P, and (b) paid the price with the said credit card; (c) provided the Defendant with 27,700 won from the owner of the above title store in the name of the Defendant believed to be the legitimate holder; (d) received food equivalent to KRW 120,000 from the owner of the restaurant business under his name in the same manner as “I” in “I” in the same manner at around 0:59 on the same day; (c) received food equivalent to KRW 32,00 from the owner of the business under his name in the same manner at around 01:03; and (d) received food equivalent to KRW 32,000 from the “J” in the same manner at around 01:10 on the same day.
The defendant used stolen credit cards illegally, and received property by deceiving victims.
