A. A sales contract concluded on July 26, 2019 between Defendant A and C is concluded.
Reasons
1. Basic facts
가. 신용보증계약의 체결 원고는 C과 사이에 ① 2014. 3. 14. 보증금액 99,000,000원(이후 81,000,000원으로 변경), 보증기간 2016. 3. 11.까지(이후 2020. 3. 9.까지로 변경)로 정하여 C의 D은행에 대한 대출 채무를 90%의 비율로 보증하는 신용보증계약을, ② 2018. 3. 14. 보증금액 180,000,000원, 보증기간 2019. 3. 13.까지(이후 2020. 3. 13.까지로 변경)로 정하여 C의 D은행에 대한 대출 채무를 90%의 비율로 보증하는 신용보증계약을 체결하였고, C이 대표이사인 주식회사 E(이하 ‘소외 회사’라 한다)과 사이� ③ 2017. 4. 27. 보증금액 198,000,000원(이후 189,000,000원으로 변경), 보증기간 2018. 4. 26.까지(이후 2020. 4. 24.까지로 변경)로 정하여 소외 회사의 D은행에 대한 대출 채무를 90%의 비율로 보증하는 신용보증계약을, ④ 2018. 3. 14. 보증금액 90,000,000원(이후 81,000,000원으로 변경), 보증기간 2019. 3. 13.까지(이후 2020. 3. 13.까지로 변경)로 정하여 소외 회사의 D은행에 대한 대출 채무를 90%의 비율로 보증하는 신용보증계약을(이하 통틀어 ‘이 사건 신용보증계약들’이라 한다)을 체결하였고, C과 소외 회사는 D은행으로부터 대출을 받았다.
