A shall be punished by imprisonment of two years and four months, by imprisonment of Defendant B, by imprisonment of eight months, by a fine of three million won, respectively.

Punishment of the crime

1. No person who violates the Trademark Act shall transfer or deliver any goods identical with or similar to the designated goods on which another person's registered trademark or similar trademark is marked, or carry for the purpose of transfer or delivery, or infringe on the trademark right;

가. 피고인 A 피고인은 자신의 처인 H와 함께, ‘I’, ‘J’ 라는 상호의 인터넷 통신 판매사이트 (K, L)( 이하 ‘ 쇼핑몰’ 이라고만 한다 )를 통하여 ‘ 샤넬’, ‘루 이비 통’, ‘ 구 찌’, ‘ 프라다’, ‘ 버버리’ 등의 위조 상표가 부착된 가짜 명품 가방, 지갑, 벨트, 신발, 의류, 시계, 악세사리 등을 판매하기로 공모하고, 2016. 3. 23. 경 ‘I’ 쇼핑몰을 통하여 M에게 상표권 자인 ‘루 이비 똥 말 레 띠에’ 가 대한민국 특허청에 상표 등록한 ‘LOUIS VUITTON' 의 위조 상표가 부착된 머니 클립 1점( 정품 시가 80만 원 상당) 을 94,800원에 판매한 것을 비롯하여, 2009. 4. 경부터 2016. 6. 22. 경까지 첨부 파일 범죄 일람표 1 기 재와 같이 ‘I’ 쇼핑몰을 통하여 같은 방식으로 68,285회에 걸쳐 판매가 합계 10,073,502,579원 상당( 정품 시가 1조 원대 추정) 의 ‘ 샤넬’, ‘루 이비 통’, ‘ 구 찌’, ‘ 프라다’, ‘ 버버리’ 등 유명 상표가 새겨진 가짜 명품 가방, 지갑, 벨트, 신발, 의류, 시계, 악세사리 등을 판매하고, 2016. 6. 9. 경부터 같은 달 21. 경까지 첨부 파일 범죄 일람표 2 기 재와 같이 ‘J’ 쇼핑몰을 통하여 같은 방식으로 53회에 걸쳐 판매가 합계 5,554,880원 상당의 ‘ 나이 키’, ‘ 아디다스’ 등 유명 상표가 새겨진 가짜 명품 신발 등을 판매하였다.

Accordingly, the Defendant conspiredd with H to infringe on the trademark rights of the above trademark holders.

B. Defendant B (1) Joint Crimes with Defendant A was committed on January 2016 by phone call to Defendant A, known to and from the time of residing in China, at the shopping mall.
