The prosecution of this case is dismissed.

Reasons

From December 7, 2010, the summary of the facts charged, the Defendant entered into a check contract in the name of the former Socco-dong branch of the National Bank and the Defendant, and traded household checks.

1. On July 14, 2014, at the Defendant’s office in Dongdaemun-gu Seoul, the Defendant issued one copy of the bank check in the name of the Defendant, namely, the check number “C”, the check amount “3,00,000 won”, and the issue date “ October 11, 2014”.

On October 13, 2014, the holder of the check at issue, presented the check to SC Japan on October 13, 2014, which was within the time limit for presentment of payment, but the defendant did not pay the check due to the shortage of deposit.

2. On July 14, 2014, the Defendant issued one copy of the above bank household check in the name of the Defendant, which was named as “D”, “3,00,000,000” and “date of issuance” at the place indicated in the above paragraph (1).

On October 13, 2014, the holder of the check at issue, presented the check to the National Bank on October 13, 2014, which was within the payment presentation period, but the defendant did not pay the check due to the shortage of deposit.

3. On July 14, 2014, the Defendant issued one copy of the bank household check in the name of the Defendant, which was named as “E”, “E”, “3,00,000,000”, and “ October 11, 2014” at the place indicated in the foregoing paragraph (1).

On October 13, 2014, when the F, who is the holder of the said check, presented the check to the Industrial Bank on October 13, 2014, which was within the time limit for presentment for payment, but the Defendant did not pay the check in shortage.

4. On July 14, 2014, the Defendant issued one copy of the bank household check in the name of the Defendant, which was named as “G”, “C”, “3,000,000 won”, and “ October 11, 2014” at the place indicated in the foregoing paragraph (1).

On October 15, 2014, which is the holder of the said check, the owner of the said check, proposed to pay the above check to the Nonghyup on October 15, 2014, but the Defendant did not pay the shortage of deposit.

5. The Defendant around July 14, 2014, at the place specified in the foregoing paragraph (1), and the check number “H”.
