이러한 경우 자동차의 운전 업무에 종사하는 사람에게는 전방 및 좌우를 잘 살피는 등 안전하게 운전하여 교통사고를 미연에 방지하여야 할 업무상의 주의의무가 있었음에도 불구하고, 피고 인은 위와 같이 술에 취한 상태로 이를 게을리 한 채 진행한 과실로, 피고인의 전방에서 신호 대기를 하고 있던 피해자 C(48 세) 운전의 D 아반 떼 승용차의 뒷 범퍼 부분을 위 쏘나타 승용차의 앞 범퍼 부분으로 충격하고, 그 충격으로 위 아반 떼 승용차가 전방으로 밀리면서 그 전방에 정차하고 있던 피해자 E( 여, 32세) 운전의 F 스파크 승용차의 뒷 범퍼 부분을 위 아반 떼 승용차의 앞 범퍼 부분으로 충격하고, 위 아반 떼 승용차가 위와 같이 스파크 승용차를 충격한 후, 좌측으로 튕기면서 3 차로에 정차하고 있던 피해자 G(45 세) 운전의 H 제네 시스 승용차의 조수석 쪽 뒷 펜더 부분을 위 아반 떼 승용차의 앞 범퍼 부분으로 재차 층격하고, 위 스파크 승용차가 전방으로 밀리면서 그 전방에 정차하고 있던 피해자 I(26 세) 운전의 J 골프 승용차의 뒷 범퍼 부분을 위 스파크 승용차의 앞 범퍼 부분으로 층 격하였다.
