1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

Purport of claim

The defendant shall pay to the plaintiffs each amount stated in the column of "claimed Amount by plaintiff in the separate sheet," and objection thereto.

The amount calculated by 20% per annum from the day after the delivery date of the copy of the complaint of this case to the day of full payment.

H. D. Payment

Reasons

1. Basic facts

A. Status of the parties

Under Article 43 of the Broadcasting Act, the Defendant’s purpose is to contribute to the promotion of public welfare, realization of social justice, protection of citizens’ fundamental rights, innovation in education and culture, promotion of national sports, and promotion of international cooperation by conducting a broadcast of domestic and foreign broadcasting as a national key broadcasting, dissemination of broadcasting culture, and businesses incidental thereto. The Plaintiffs are members of the ○○ Yeong Labor Union (hereinafter referred to as “the ○○○ Labor Union”) that was produced and broadcasted by the Defendant.

B. Around October 2002, 2002, a postponed labor union agreed on the criteria for the payment of subsidies with Defendant, ○○ Broadcasting Co., Ltd., ○○○, and ○○○ Co., Ltd. ( previous payment of subsidies was made according to custom, and it was stipulated around October 2002; hereinafter referred to as “instant criteria for the payment of subsidies”) and its main contents are as follows.

탤런트, 코미디언1. 출연료 지급은 편성시간을 기준으로 한다 .2. 주간 촬영부터 야간 촬영으로 연결된 경우 촬영시간이 6시간이 넘으면 야간 촬영수당으로 야외수당 20 % 를 가산하여 지급한다 .3. 장면 재사용료의 제도 취지에 따라 동일 프로그램 내에서 재사용하는 경우 ( 회상장면, 축약방송 등 ) 에 한해 출연료의 50 % 를 지급한다 .4. 철야출연료는 스튜디오 녹화 및 야외 촬영시 24 : 00부터 익일 05 : 00까지로 하며 익일05 : 00에서 09 : 00까지는 20 % 를 별도 지급한다 .6. 방송사는 프로그램이 방송된 후 출연료를 10일 이내에 지급하며, 방송제작을 완료하고방송사 사정에 의하여 방송하지 아니하는 경우에는 해당 출연료 전액을 지급한다 . 2 ) 피고는 이 사건 출연료 지급기준을 기초로 하여, 매년 연기자노조가 피고와 체결하는 출연료 기준표 ( 연기자의 등급별 10분당 기본료 및 그 할증기준 ) 에 따라 드라마 연기자에게 출연료를 지급하였는데, 출연료의 구체적인 액수 산정은 연기자가 해당 회차 방송에 출연하였다면 실제 그 출연시간에 관계없이 연기자별로 6등급부터 18등급까지 정해지는 등급에 따른 10분당 기본료에 회당 편성시간을 곱하여 산정하되, 출연하는 드라마의 종류 ( 일일연속극, 주간 · 주말 연속극, 단막극, 미니시리즈 · 특집극 ) 와 회당 편성시간 별로 정해진 할증율에 따른 할증금액을 가산하여 산정하였다 .

2. Determination as to the cause of action

A. The plaintiffs' assertion

According to the instant standards for the payment of contributions, the amount of contributions by postponed is calculated on the basis of “the time of compilation.” This is based on the premise that the actual time of compilation is consistent, and if the actual time of broadcasting exceeds the time of compilation, the amount of contributions should be calculated on the basis of actual time of broadcasting. Nevertheless, as the Defendant paid the contributions based on only the time of compilation, the Defendant is obliged to pay the amount of contributions corresponding to the portion exceeding the time of compilation to the Plaintiffs.

B. Determination

In light of the following facts and circumstances, the evidence submitted by the Plaintiffs alone is insufficient to recognize the reason or ground for the Defendant to calculate the amount of contribution on the basis of the actual hours of the pertinent drama, and there is no other evidence to acknowledge that there is no reason otherwise. Accordingly, according to the criteria for the payment of contributions of this case concluded by the postponed labor union and the Defendant, the payment of the amount of contribution is clearly determined on the basis of the “amount of contribution”. 2) In manufacturing and broadcasting the drama, it is difficult to set the standards for the payment of the instant amount of contribution. 2) The reason why the postponed labor union and the Defendant prepared the payment of the amount of contribution of this case on the basis of the “amount of contribution”. The reason why the actual number of persons to be postponed in making and broadcasting the drama is no longer than the number of hours to be taken at the place of recording (such as time or division of time, etc.) or the number of hours to be taken by the NGs, etc. due to the fact that it is difficult for the investors to determine the amount of contribution.

3) Accordingly, in calculating the contribution fee of the postponed, the postponed labor and the Defendant calculated on the basis of the “time of programming” in consideration of the unique nature of the drama production and broadcast as above, but if the postponed only contributes to a short-term accident in one drama, regardless of the actual time of contribution, it shall be calculated by multiplying the basic contribution fee per ten minutes on the basis of the “time of programming” of the relevant drama regardless of the actual time of contribution, by the number of times of compilation per minute; however, it shall be calculated by adding the premium per ten minutes on the basis of the “time of programming of the relevant drama”; however, in calculating the basic contribution fee per ten minutes as above, the basic contribution fee per ten minutes shall be calculated by dividing the class by the postponed by taking into account the weight of the drama in question, the frequency of contribution, etc. (Provided, That in calculating the basic contribution fee per ten minutes as above, the basic contribution fee per ten minutes was set by dividing the class by the postponed.

4) The plaintiffs asserted that the criteria for the payment of the instant fee were set on the premise that the actual time of the drama’s broadcasting time is the same as the actual time. However, there is no evidence to acknowledge that the time of the program was set on the premise that the actual time of the program is the same as the actual time of the program. Rather, the actual time of the TV program including the drama is different from the table of the broadcasting station. In addition, in the case of the drama, the actual quantity of the broadcasting program was determined through editing after photographing the expected quantity of the program on the same day. As a result, the actual time of the drama’s broadcasting time is determined differently (in the case where the actual time of the drama’s broadcasting time is almost the same as the actual time of the drama’s broadcasting time, it is difficult to view that there is a difference between the extended time of the drama’s broadcasting time and the actual time of the drama’s broadcasting time in light of the circumstances that the late broadcasting time is more than the actual time of the program’s production and announcement, etc. as seen earlier, it is difficult to view that the actual time of the programming and announcement.

6) According to Gap evidence No. 5 (Agreement), the agreement was made between the defendant and the above trade union to set up an agreement to the effect that ○○○○○ Do governor Kim○-○ and the defendant’s copyright team leader gave up the right to the difference between the contributions made by the contributors arising from the difference in the ○○○○ time excess of the contributions made in the line of Round on May 7, 2008, such as large class, large class, large class, and fire fighting, and prevent the filing of the lawsuit by the contributors.
