The prosecutor's appeal is dismissed.
Reasons
The prosecutor appealed against the lower court’s punishment (the suspension of sentence: four months of imprisonment) that is too minor.
However, the lower court’s sentencing is not recognized to be unfair in light of the following: (a) there is no particular change in the sentencing conditions compared with the lower court; and (b) the fact that the Defendant was the first offender and some of the circumstances leading to the instant case may be considered in light of the records and arguments of the instant case.
Therefore, the prosecutor's appeal is dismissed.
