The defendant's appeal is dismissed.

1. At the time of the instant accident with the summary of the grounds for appeal, the Defendant did not receive the insurance money by altering the location of the traffic accident and by deceiving the insurance money in collusion with E, who is the counterpart driver of the vehicle, on the wind of the Defendant at the time of the instant accident.

Nevertheless, the court below which found the defendant guilty has erred by misunderstanding facts or by misunderstanding legal principles, which affected the conclusion of the judgment.

2. Comprehensively taking account of the following circumstances acknowledged by the evidence duly adopted and investigated by the court below, the defendant can fully recognize the fact that the accident of this case was received as an "accident with a parked vehicle" from the insurance company after facing the horses of E despite the fact that the accident of this case was an cross-section accident, and that the insurance money was acquired by receiving the insurance money.

Therefore, the judgment of the court below is just and acceptable, and there is no error of law by misunderstanding the facts or misunderstanding the legal principles as pointed out by the defendant, and the defendant's assertion is not accepted.

① E, the counterpart driver of the instant accident, stated at an investigative agency that the accident occurred at the same time, and consistently stated to the effect that he/she received the insurance company in line with the Defendant, even though the same was reversed and the fact from the original judgment to the court below was an accident in the intersection, even if the accident occurred at the parking lot.
