Punishment of the crime

[Criminal Power] On March 16, 2017, the Defendant, at the Seoul Central District Court, sentenced two years and six months to imprisonment for a violation of the Act on the Control of Narcotics, Etc., and completed the execution of the sentence in the Busan Correctional Institution on April 14, 2018.

【Criminal Facts】

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (one philophone, hereinafter “philophones”) and marijuana as follows:

1. On October 27, 2018, the Defendant purchased approximately 30 g of philopon from D within 4.5 million won in a numberless BW car operated by D, which was parked in front of the restaurant located in Seongbuk-gu Seoul, Seongbuk-gu Seoul around October 27, 2018.

2. On November 19, 2018, the Defendant: (a) around 17:00 on November 19, 2018, parked in front of the F High School located in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, sold 9.37g of philopon to H in GWz car operated by the Defendant at KRW 1.5 million.

3. On December 4, 2018, around December 4, 2018, the Defendant: (a) injected a phiphone; and (b) smoke of marijuana around December 4, 2018, around the new wall, the Defendant injected approximately 0.05g of philopon into a single-use injection machine at the Defendant’s residence located in Seongbuk-gu Seoul Metropolitan Government and J; (c) injected it into the blood pipe; and (d) continuously injected it by inserting it into a pipe made of stuffed paper.

Accordingly, the Defendant administered philophones, and smoked marijuana.

4. On December 4, 2018, the Defendant, holding a penphone or marijuana, around December 16, 2018, kept approximately KRW 49.63g, in a vinyl bag and a disposable injection machine, and kept approximately KRW 7.35g, in its original form, etc., in which the Defendant, at around December 4, 2018, carried approximately KRW 49.63g, in which the Defendant’s residence was divided into plastic bags and a disposable injection machine.

Accordingly, the defendant possessed philophones and marijuana respectively.
