A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is not a foreigner of Thailand who is not a person handling narcotics, and is not a foreigner of Thailand, so the defendant shall not sell or administer a Mepopon (one philopon, hereinafter referred to as "philopon").
1. Sale and purchase of phiphones;
A. A. On July 12, 2020, the Defendant, along with B, sold 300,000 won in cash by bearing KRW 1.50,000 from July 12, 2020 to 02:0,000, from Sinti City C building and “D” on the third floor, respectively, and purchased 1,50,000 won in cash.
Accordingly, the Defendant conspired with B to sell philophones.
B. On July 24, 2020, the Defendant, along with B on July 24, 2020 from around 08:00 to 09:00, imposed KRW 230,000 and KRW 2.220,000,000 on the F building in Silung City, from around 08:00 to around 09:0, respectively, and traded a written phone with the Defendant’s nameless winners (the name “H”).
Accordingly, the Defendant conspired with B to sell philophones.
C. On July 28, 2020, the Defendant: (a) around 10:00 on July 28, 2020, sold 90,000 won in cash to the person who was killed in the name under the above G (i.e., “H”); and (b) obtained approximately two g from the above person who was unaware of the name, and traded phiphones.
Around August 14, 2020, the Defendant, on August 14, 2020, sold 70,000 won in cash from the above G from around 08:00 to 09:0,000, to the person who was not killed in the name (H) in the above G from around 08:00 to around 09:00.
E. Around August 29, 2020, the Defendant, on August 29, 2020, purchased and sold 90,000 won by cash and account transfer from around 08:00 to 09:0,000, to a person who was killed in the name (i.e., “J”) on the street before Incheon I (i.e., “J”) from around 08:00 to around 09:00.
F. On September 1, 2020, the Defendant committed the crime on September 1, 2020, the name of a person who was not killed in the name in front of the Incheon Office Office convenience store from around 07:00 to 08:00.
