1. The Defendant’s each of the Plaintiffs’ KRW 310,365,00 and 5% per annum from March 29, 2013 to July 23, 2014.
Reasons
1. Basic facts
A. As to E forest land E, 16,361 square meters (the registration conversion was made in F forest land 17,207 square meters on May 4, 2010) and G forest 18,375 square meters (hereinafter “H forest 18,00 square meters on June 7, 201), Plaintiff A owned 1/20 shares, Plaintiff B owned 5/20 shares, Plaintiff C owned 14/20 shares, respectively, and Plaintiff C owned 10,169 square meters (the registration conversion was made in J forest 18,775 square meters on May 4, 2010) and G forest 18,375 square meters (the registration conversion was made in H forest 18,775 square meters on May 4, 2010).
(hereinafter referred to as “each of the instant real estate”) B.
Each real estate of this case was completed the registration of establishment of a mortgage of KRW 2.396 billion for the debtor C, the mortgagee, and the maximum debt amount of KRW 2.36 billion on June 9, 2010 to secure the obligations for loans of KRW 1.843 billion against the plaintiff C’s coal mine agricultural cooperatives (hereinafter “UF”).
C. On April 18, 2011, the Plaintiffs concluded a sales contract (hereinafter “instant sales contract”) with K (i.e., e., e., e., e., e., e., g., e., e., e., g
1. Sales proceeds: 3.10 million won;
2. Provisional contract amount: 20 million won.
3. Buyer: K.
4. The guarantor of purchase: Jinyeong Co., Ltd.
5. Details of consultation on contracts;
(a)the amount of sale shall be 3.1 billion won;
(b) the amount of provisional contract shall be twenty million won;
C. This Agreement is concluded on April 30, 201 at the time of payment of the down payment of 300 million won.
The payment date of the first intermediate payment shall be May 20, 201, and the intermediate payment shall be 400 million won.
(e) at the request of the seller, the borrower may change the buyer to the buyer the defectiveness of the sale (which appears to mean the obligation of collateral loan to the NAFF) at the time of the payment of the down payment or the first intermediate payment.
(h) In the event of a provisional contract, the seller agrees to set up three billion won in total amount of the local public enterprise.
Provided, That where the buyer fails to perform the contract, the establishment may be terminated.
