1. The Defendants are jointly and severally liable to the Plaintiffs for KRW 99,00,000 and KRW 27,000,000 among them, from May 9, 2012.
Reasons
1. Basic facts
A. The Defendants, prior to the division, purchased the price of KRW 14,777 square meters in E forest land, KRW 793 square meters in F, and KRW 456,50,000 in G site in Si/Gun/Gu prior to the division, and carried out a business in which the said land is divided into a housing site and sold in lots. The Plaintiffs are the buyers who entered into a sales contract with the Defendants on certain housing sites.
B. After dividing H forest land into 3,442 square meters in E forest land, 887 square meters in J forest land, 109 square meters in J forest land, and 1,021 square meters in K forest in Si/Gun/Gu related to the division of sale subject matter, E forest land is subject to registration conversion into 9,559 square meters in L forest, and 6,113 square meters in M forest and 3,446 square meters in Sejong Special Self-Governing City due to the change of administrative district name.
C. On May 10, 2012, the Plaintiffs concluded a contract with the Defendants to purchase KRW 562 square meters (attached Form Nos. 11,335 square meters of E Forest Land, E, and KRW 90,000,000,000 from May 29, 2012. The Plaintiffs agreed to pay KRW 18,000,000,000 on the date of the contract, and the intermediate payment of KRW 45,00,000,000 on May 29, 2012, at the same time as the delivery of documents necessary for the transfer registration of ownership and the delivery of the subject matter of the sale. The Plaintiffs agreed to adjust the remaining amount of the contract when the area of the subject matter of the sale changes in the area of the subject matter of the civil works and in the process of the completion and subdivision of the works.2) The Plaintiffs transferred the amount of KRW 27,00,000 on the date of the contract to the intermediate payment under the name of each Defendant C.
1) The instant secondary sales contract was concluded between the Plaintiffs and the Defendants on July 4, 2012, as E forest land, which is the object of the instant primary sales contract, was divided into 3,446 square meters of Lan Forest and 3,446 square meters of land, and the ownership transfer registration was completed in Defendant D’s name as to Lan Forest and 3,446 square meters of land. Accordingly, the instant secondary sales contract was concluded between the Plaintiffs and the Defendants on July 4, 2012.
