A defendant shall be punished by imprisonment for not less than four years and six months.

The defendant will pay 450 million won to the applicant by fraud.

Punishment of the crime

On February 17, 2014, the Defendant: (a) was aware of the fact that the Victim E received KRW 200 million of the death insurance money from the Plaintiff’s parents of the Busan National University, who died while opening a meeting for returning new students at a sports center on February 17, 2014; and (b) was aware of the fact that the Defendant received the amount equivalent to KRW 200 million of the death insurance money.

On October 23, 2014, the Defendant: (a) took place in the Busan Southern-dong Busan-dong-dong-gu Busan-do-gu Busan-do-U.S. Busan-do-U.S.-S.-gu-U.-U.S.-S.-S.-gu-U.-U.S.-S.-gu-U.S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S.-S., the Defendant said that “The Defendant would pay KRW 200,000 per month interest if the Defendant borrowed KRW 20,000,000 to be invested in the project, and paid the principal to the Plaintiff by November 30, 2016.”

However, in fact, the defendant thought that he will receive money from the injured party to use it as living expenses, such as personal loan, purchase of high-class external vehicles, apartment monthly rent, mobile phone fee, and telephone accommodation fee, etc., but he did not think that he will make an investment in the type business, and even if he borrowed money with no special revenue source, he did not have the intention or ability

As such, the Defendant, by deceiving the victim, received a total of KRW 200,000 won of the face value of KRW 100,000 on the same day from the victim, and acquired it by fraud.

The Defendant, on September 2013, 2013, joined as a “G” member, a golf club located in Busan Metropolitan City, and then accessed the victim C (54 years of age, female) (hereinafter “G”), a general partner of the club, thereby getting an architect. The wife is an international attorney-at-law, and the wife owns three F apartments in the shipping club, and is able to have considerable financial power, and the victim is a good example.
