Reasons
Punishment of the crime
1. Crimes against victims C;
A. Although the Defendant was willing to use the money for personal purposes, such as living expenses, repayment of borrowed money, etc. even if it was received from the victim, the Defendant made a false statement to the effect that “On December 3, 2010, the E-university located in Nam-gu Incheon Metropolitan City, in order for the said victim to obtain a loan from a company that is unable to obtain a loan from a bank, and is engaged in a business that receives a fee in return, and is receiving 15% of the investment money as a monthly dividend,” the Defendant received 200,000 won from the victim’s account in the name of the Defendant designated by the Defendant on the same day from the day to March 5, 2013, all of which were obtained 4109,950,000 won through a bank account in the name of the Defendant from around that day.
B. From March 7, 2013 to April 22, 2013, the Defendant was willing to use the money received from the victim for personal purposes, such as reimbursement of debts, living expenses, etc., the Defendant obtained KRW 12 million from the victim’s bank account in the name of the Defendant at the time of exchange and receive fees from the victim C.
