A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Fraud against the victim C;

A. A. Around April 7, 2014, the Defendant told the victim at the “E” coffee shop located in Gangnam-gu Seoul, Gangnam-gu, that “I would make profits more than 100% if the Defendant invests in the investment of futures options.”

However, even if the defendant received money from the victim, he did not think that he will use it for an individual purpose, and did not think that he actually made an investment, and there was no intention or ability to return the money to the victim.

As above, the Defendant, by deceiving the victim, received money from the victim to the bank account in the name of the Defendant in the name of the same day as the investment money from the victim.

B. On May 2, 2014, the Defendant recommended the victim to obtain a loan from the lending institution and invest in the lending institution at the E coffee shop, and stated that “The lending would be made available after receiving the loan, and the money will be treated as a futures option investment.”

However, the defendant did not think that he would use the above money for his personal purpose even if the defendant delivered the passbook to which the victim paid a loan to the defendant, and did not think that he actually made an investment.

Around May 2, 2014, the Defendant, by deceiving the victim as above, got the victim to borrow a total of KRW 18,49,000 from mountain and loan corporations, etc., and acquired the above money by means of receiving a corporate bank passbook and cash card in the name of the victim whose money has been deposited.

2. On February 2014, the Defendant against the victim F is the victim at the Human Entertainment Office, where the trade name located in the Gangnam-gu Seoul Metropolitan Government Cheongdo-dong is unknown, “I would bring profits more than 100% if the Defendant makes an investment in the futures options to the victim.”
