1. 피고인은 2016. 4. 14. 11:58 경 부산 사하구 B에 있는 C 점 내에서 피해자 D( 여, 31세 )에게 휴대전화 E 메신저를 통해 “ 이쁜 이 찌 찌를 언제 보냐고 해 따 ㅋㅋ” 라는 문자 메시지를 보내고, 같은 날 13:00 경 “ 이쁜 이 찌 찌 상상에 생각이 없노”, “ 오빠는 니랑 하고 싶농 ㅋㅋ” 이라는 문자 메시지를 보냄으로써 자기의 성적 욕망을 유발하거나 만족시킬 목적으로 통신매체를 통하여 성적 수치심이나 혐오감을 일으키는 글을 피해자에게 도달하게 하였다.
