1. On April 27, 2016, the Plaintiff (Counterclaim Defendant) paid KRW 10,055,290 to the Defendant (Counterclaim Plaintiff) and its related amount.
Reasons
A principal lawsuit and counterclaim shall be deemed to be combined.
1. Basic facts
A. On December 12, 2013, the Plaintiff entered into a lease agreement (hereinafter “instant lease agreement”) with the Defendant on the leased deposit amount of KRW 20,410,00, monthly rent of KRW 1,871,195 (including value-added tax), and the lease agreement between December 16, 2013 and December 15, 2014, which connects each point of “A, B, D, E, F, L, L, and A” (hereinafter “instant private teaching institute”).
Article 2 (Term of Lease) The term of this Agreement shall be 12 months from December 16, 2013 to December 15, 2014.
Provided, That if there is no separate written opinion of the lessor or lessee by two months before the expiration of the lease term, it shall be considered to have been automatically extended for one year without preparing the contract under the same conditions as this lease contract.
Article 4 (Return of Deposit) (1) Where the lease term of this contract expires or the contract has been terminated, the lessor shall refund the deposit when the lessee completely orders the leased property and fully pays all kinds of obligations to the lessor.
Article 8 (Arrears of Rental Deposit, Rent, etc.) If a lessee fails to pay the amount of the deposit, monthly rent, etc. by the due date, the late payment shall be made with the interest rate applied by the period of arrears under Article 72 of the Decree on the State Property under the State Property Act as of January 1 of the relevant year, and one month shall be 30 days.
The lessor performed soundproof construction with the consent of the lessee in relation to the noise generation at the time of the conclusion of the contract, and the lessee does not object to the lessor in relation to the noise unless the noise level is greater than the present condition of the construction after the execution of the contract (the present condition is the current condition, the lessee, and the contractor's mutual confirmation).
