A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who was in de facto marital relationship from April 30, 2007 to January 201 with the victim C (nive, 40 years of age) and from April 30, 2007.

On January 1, 201, at around 15:00, the Defendant, at the Defendant’s house located in Youngdo-gu Busan Metropolitan City (D apartment 207 dong 403), sent a phone call from the victim’s cell phone to the victim’s cell phone who was unable to see the Defendant’s violence and harassment during the course of coming to the house, and told the victim “I have come to the house due to a large number of difficulties that might not come to the house.”

피고인은 미리 준비한 위험한 물건인 주방용 식칼(총 길이 40cm)을 들고 화장실에 들어가 피해자를 기다리던 중 피해자가 집안으로 들어오자 피해자의 등 뒤에서 피해자의 목에 식칼을 들이대고 피해자를 안방 장롱 쪽으로 이동하게 한 후 피해자에게 “꿇어앉으라”라고 말하여 피해자를 꿇어앉게 만든 후 신발을 신은 발로 피해자의 얼굴, 팔 등 온몸을 수회 밟고 걷어차고, 계속하여 “도망가고 싶으면 도망가 봐라. 대신에 니 옷 다 벗어라”라고 말하여 피해자에게 옷을 모두 벗게 한 후 옷을 벗은 피해자를 향해 욕설을 하며 재차 주먹과 발로 피해자의 얼굴과 배를 수회 때리고 피해자에게 “야 이 씨발년아, 이제부터 여기서 못나간다. 니 꼼짝도 하지 말고 누워 있어라”라고 말하며 피해자를 바닥에 눕게 한 후 피해자를 강간할 것을 마음먹고, 피해자의 몸 위에 올라가 다리를 오므리고 손으로 밀쳐내며 거부 의사를 표시하는 피해자에게 “가만히 있어라, 씨발년아”라고 말하며 이마로 피해자의 얼굴을 수회 내리치고, 피해자의 팔을 잡아 누른 후 피해자의 다리를 때려 피해자의 다리를 벌리게 하는 등 반항하지 못하게 한 후 피해자를 1회 간음하여 강간하였다.
