A defendant shall be punished by imprisonment for not less than two years and six months.

The defendant shall be ordered to complete a sexual assault treatment program for 100 hours.

Punishment of the crime

1. The Defendant, at around 00:00 on January 7, 2014, tried to put the victim’s sexual organ into the part of the victim’s panty, and to put the victim’s sexual organ into the part of the victim’s sexual organ at the home of the victim D (the age of 45) who was in an internal relationship with the victim of another male and female at the time of the victim’s sexual intercourse with the victim, and did not conclude that the victim’s sexual organ was not carried out because the victim’s sexual intercourse with the other male and female.

2. 강간상해 피고인은 제1항 기재 일시로부터 약 2시간 정도 지난 후 제1항 기재와 같은 장소에서 피고인이 재차 피해자에게 “다른 남자와 성관계를 한 것이 아니냐”라고 물었고, 피해자가 “아니다”라고 하자 피고인은 “어디 거짓말 하냐”라고 말하며 손바닥으로 피해자의 오른쪽 뺨을 1회 때리고 위험한 물건인 가위(날길이 15cm)를 들고 피해자가 입고 있던 티셔츠와 브래지어를 잘라 알몸이 되게 한 후 “옷 입을 생각마라, 옷 입으면 죽일꺼니까, 너는 고통을 받아봐야 한다, 꼼짝 말고 누워 있어라, 일어나면 죽인다”라고 말하여 겁을 주고, 사과 반쪽을 피해자의 음부에 집어넣은 뒤 입으로 피해자의 왼쪽 무릎을 깨물고 가위로 피해자의 음부 부위의 털을 자르며 가위로 피해자의 양 허벅지를 수회 때렸고 그 뒤 화장품 샘플용기를 피해자의 항문에 밀어 넣었다.
