A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On July 28, 2008, the Defendant received a summary order of KRW 1.5 million as a fine for a violation of the Road Traffic Act, and KRW 2 million as a fine for a violation of the Road Traffic Act in the same court on January 20, 2015.
1. A person who violated Article 44(1) of the Road Traffic Act at least twice again, and the Defendant once again drives a motor vehicle in Frop in a state of under the influence of alcohol content of about 200 meters from the front road located in Jinju-si B around October 4, 2018 to the front road located in D at the same time.
2. On October 4, 2018, the Defendant: (a) was under the influence of alcohol on the front of “E” on the road in Jinju-si, Jin-si, as described in paragraph (1) on the front of “E” on the road; (b) was shocked by the preceding G driving’s HH business car.
