1. Basic facts

A. The F Co., Ltd., Ltd. F (hereinafter “F”) concluded a H contract of KRW 500,000 as a fire-fighting property liability security (hereinafter “first-story insurance contract”) on June 26, 2015, with the subject matter of insurance, with the second-story factory located in Gangseo-gu Busan Metropolitan Government (hereinafter “instant factory”); and E Co., Ltd. (hereinafter “E”) is an insurer operating non-life insurance business, etc., and the F Co., Ltd. (hereinafter “E”). On February 11, 2015, concluded an insurance contract of KRW 20,000,00 as a fire-fighting property liability security (hereinafter “first-story insurance contract”) with the subject matter of insurance with the fire-fighting property, office building, and boiler room as the subject matter of insurance.

B. On October 28, 2015, around 05:33, when the instant fire occurred, the fire occurred in the instant plant (hereinafter “instant fire”). As a result, among the owners of the factories, offices, etc. adjacent to the instant plant, the Plaintiff suffered damages equivalent to KRW 3,284,240,045, a total of KRW 379,895,495,495, and KRW 2,304,550, which was not compensated for the insurance amount of KRW 979,89,895,495, and KRW 2,304,550, which was not compensated for the insurance amount of KRW 979,89,895,00, and KRW 60,500,000 as the rooms of the office, etc.; and KRW 12,571,628, as the rooms of the office, etc.

C. On March 28, 2016, the Plaintiff (hereinafter “B”) against F on March 28, 2016, as the Busan District Court 2016 tea6469, and the Plaintiff was Defendant B Co., Ltd. (hereinafter “B”).

In addition to the insurance money to be paid according to an insurance contract entered into with the Defendant, the said court filed an application for the payment order claiming the payment of KRW 2,304,344,550, and the said court filed an application for the payment order on March 28, 2016.
