A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around November 2016, the Defendant d (math, 62 years of age) and three-year intersections with the victim C (math, 33 years of age). In recent years, the Defendant had been aware that the victim D was married to another male, and had been aware of the fact that the victim D had been married to the other male, and had been willing to take money by raising money by deceiving the sexually related video taken under D’s consent at the time of sending the victim D’s sexually related relationship to the victim C, who was his mothered, and did not contain “the required matters,” and by threateninging the victim C, who was aware of the fact that the victim D had been married to the other male.
1. On September 8, 2017, the Defendant: (a) sent the second text message to the effect that, in his/her own residence, the Defendant would transmit to the victim C the victim’s cell phone a text message to the effect that, “D has become aware of the last time of marriage; (b) demanded KRW 100 million for material and mental distress; and (c) would transmit the sexually related images with his/her father to his/her husband, etc. at the time when he/she would not transfer them to the victim; and (d) sent the second text message to the effect that, at around 11:32 of the same day, the Defendant would transmit all the decisions in the same manner as “on the other hand, transmit them to all the persons who did not have yet been determined.” At around 09:15 on the same day, the Defendant sent the victim’s cell phone message to the victim in the same way as “on the same day from now to time in accordance with the reservation order.”
The defendant, who received money from the frighter C, was not able to receive money from the frighter C, but did not receive money from the frighter C.
2. Where a person takes photographs of another person's body against his/her will, or where he/she takes photographs of another person's body, which may cause sexual humiliation or shame by using a camera or other mechanical device equipped with similar functions, such as a camera, at the time of taking such photographs;
