1. The defendant shall be the plaintiff.
(a) Map 1. List 2 of the first floor of the real estate listed in Schedule 1.
Reasons
1. Facts of recognition;
A. On March 2015, the Defendant entered into a lease agreement with the Plaintiff, setting the lease deposit amount of KRW 3,00,000, KRW 33,700, the end of each month of the rent payments, the end of March 4, 2015, and the lease period of March 3, 2017 (hereinafter referred to as “instant lease agreement”) to lease the leased portion of KRW 42.72 square meters in the ship connected each point in sequence, among the one storys of the real estate listed in paragraph (1) of the attached Table 1, as indicated in the attached Table 1, owned by the Plaintiff (hereinafter referred to as “instant lease agreement”).
B. However, from October 2015, the Defendant began to delay the rent stipulated in the instant lease agreement.
C. Accordingly, on August 30, 2016, the Plaintiff: (a) on August 30, 2016, issued the Defendant with the content of “the instant lease agreement terminated due to the failure to pay two or more rents; (b) the Plaintiff’s failure to return the instant house by September 30, 2016,” and “the content certification of the instant case.”
A) Around that time, this case’s content certification was served on the Defendant. D. The Defendant continued to use and benefit from this case’s housing from the date of commencement of the contract term stipulated in the instant lease agreement until then. [The fact that there is no dispute over the grounds for recognition, and the purport of the entire pleadings, as stated in subparagraphs A and 3.

According to the above facts of determination, the instant lease agreement was lawfully terminated at the time of delivery of the document verifying the content of the instant lease agreement, stating the Plaintiff’s declaration of termination of the lease agreement on the ground of the Defendant’s failure to pay two or more rents, and thus, the Defendant is obligated to deliver the instant house to the Plaintiff. From October 1, 2015 to September 2016, totaling KRW 404,400 (i.e., monthly rent of KRW 33,700 x 12 months) and the amount of unjust enrichment equivalent to the amount of rent of KRW 33,70 per month from October 1, 2016 to September 2016.
