2. 성폭력범죄의처벌등에관한특례법위반(카메라등이용촬영)미수 피고인은 2018. 12. 5. 13:45경 위 1.항 기재 화장실 남성용 칸에서, 여성용 칸에 사람의 인기척이 있자, 휴대폰을 손으로 벽 옆의 공간으로 넣은 후 그곳에서 용변을 보기 위하여 하의와 속옷을 내리던 피해자 E(가명, 나이불상)를 촬영하고자 하였으나 카메라의 ‘찰칵’ 소리를 듣고 뒤를 돌아보던 피해자가 피고인 소유의 카메라를 발견하고 다른 사람들에게 구조를 요청하자 그 뜻을 미루지 못하고 미수에 그쳤다.
