Punishment of the crime
[Defendant A’s criminal records] On May 27, 2014, the Seoul Central District Court sentenced eight months of imprisonment for fraud, and on June 25, 2015, the Seoul Central District Court sentenced one year and six months of imprisonment for fraud, etc. and completed the execution of the sentence on June 2, 2016.
[Criminal facts]
1. Defendant A and Defendant B conspired to sell fake “HNMA” and “HITROSUOTO” golf products purchased from Defendant A, as if they were intended to have access to many unspecified people at the expressway resting area and to sell them as if they were obtained in a low manner.
A. On December 30, 2016, the Defendants attempted to commit fraud and fraud made false statements to the effect that “The Defendants shall be deemed damaged at the loading and unloading site in Incheon and shall be wrapped in a single-fash golf with the market price exceeding KRW 3.5 million, and KRW 1.5 million and brought about.”
However, in fact, the above golf loans were the counterfeit products with the defendant A's label.
The Defendants, as well as the receipt of 600,000 won in cash from the victim at the seat from the victim, committed an attempted crime by deceiving each victim four times in total from November 23, 2016 to January 10, 2017, including the receipt of 60,000 won in cash. Defendant A committed an attempted crime by deceiving each victim four times from November 23, 2016 to January 11, 2017.
