Defendant shall be punished by imprisonment for a term of one year and six months.

However, the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

1. 피고인은 2017. 7. 11. 의정부시 E 아파트 102동 503호에 있는 피고인의 집과, 의정부시 F 아파트, 601동 207호에 있는 피고인 부모의 집에서 피해자 ‘가 부시 끼가 이샤 고모 데 갸 루 쏭’ 이 대한민국 특허청에 등록한 상표와 동일 또는 유사한 상표를 부착 또는 도용한 G 상의를 비롯하여 별지 범죄 일람표 (1) 기 재와 같이 피해 자인 각 상표권자의 등록 상표와 동일 또는 유사한 상표를 부착 또는 도용한 상품 등 총 52,041점( 정품 가 약 3,130,171,000원 상당) 을 판매 목적으로 소 지하였다.

2. 피고인은 2012. 12. 30. 경부터 2017. 7. 11. 경까지 온라인 쇼핑몰 “H”( 웹 주소 I)에서 피해자 ‘가 부시 끼가 이샤 고모 데 갸로 쏭’ 이 대한민국 특허청에 등록한 상표와 동일 또는 유사한 상표를 부착 또는 도용한 G 상의를 비롯하여 별지 범죄 일람표 (2) 기 재와 같이 피해 자인 각 상표권자의 등록 상표와 동일 또는 유사한 상표를 부착 또는 도용한 상품 총 16,503점( 정품 가 약 8,073,153,000원) 을 판매하였다.
