1. 2. 성폭력범죄의처벌등에관한특례법위반(13세미만미성년자강제추행) 및 아동복지법위반(아동에대한음행강요ㆍ매개ㆍ성희롱등) 피고인은 계속하여 제1항 기재 일시, 장소 근처 F약국 앞 노상에 서있던 피해자 G(여, 11세), 피해자 H(여, 11세), 피해자 I(여, 11세), 피해자 J(여, 11세)를 발견하고 피해자들에게 “나랑 같이 잘래 ”라고 말하고, 피고인이 팔짱을 낀 상태에서 자신의 팔꿈치로 피해자 H의 가슴을 눌러 피해자 H을 강제 추행하였다.
