A defendant shall be punished by imprisonment for not less than eight months and a fine not exceeding 200,000 won.
If the defendant does not pay the above fine, it shall be gold.
Reasons
Punishment of the crime
The Defendant is a person engaging in driving a rocketing car.
On March 14, 2018, the Defendant driven the said car under the influence of alcohol concentration of 0.178% among blood transfusions on March 14, 2018, and continued the intersection of E in front of the Daegu Water-gu D from the chilling surface to the chilling surface.
At the time, since it is an intersection at night and where no signal apparatus is installed, there was a duty of care to check whether a person engaged in driving service has a vehicle, etc. by reducing or temporarily stopping the speed prior to entering the intersection, and as such, there was a duty of care to drive.
Nevertheless, the Defendant, while under the influence of alcohol, neglected to do so as to take part in the part of the injured party F (F, 39 years old) who was moving to the right side of the passenger car driving from the Mag-gu to the Cheongdo-ro, Mag-do-ro (F, the 39 years old), was driven by the part on the left side of the Defendant’s vehicle, and the Defendant’s vehicle was pushed to the right side of the Defendant’s vehicle, and was parked to the right side of the intersection due to the shock, and did not immediately repair the part on the front side of the Defendant’s vehicle with the victim’s Ham-W car, which was the victim’s H, and was parked to the right side of the road. The Defendant received approximately 2 weeks of the Defendant’s personal gate back to the right side of the Defendant’s vehicle and did not immediately repair the said victim’s 886,192 won, such as replacement of the said victim’s low side of the vehicle to the right side, and did not immediately repair the victim 3.
