Defendant shall be punished by imprisonment for a term of one year and six months.

However, the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2014. 11. 22. 18:35경 광주 서구 C에 있는 이웃인 피해자 D(여, 52세)의 집에서, 술에 취해 피해자에게 ‘친구로 지내자’고 말하였으나 거절 당하였다는 이유로 화가 나, 그곳 탁자 위에 있던 위험한 물건인 쇠젓가락(길이 20센티미터) 뭉치를 들고 ‘콱’이라는 소리를 지르면서 방안에 누워 있던 피해자 D의 배를 찌르려고 하였으나 피해자가 몸을 피하는 바람에 우측 등 부분을 1회 내리찍고, 그 옆에서 컴퓨터를 하고 있던 위 D의 딸인 피해자 E(여, 16세)의 왼쪽 귀 뒤 머리 부분을 위 쇠젓가락 뭉치로 찔러 피해자 E에게 약 2주간의 치료를 요하는 두피열상 등을 가하였다.
