피고인은 2014. 10. 12. 00:05경 광주 북구 C에 있는 피해자 D(여, 58세) 운영의 E주점에서, 사귀다가 얼마 전에 헤어진 피해자 F(62세)과 피해자 D이 함께 있는 것을 보고 둘이 몰래 사귄다고 생각한 나머지 화가 나, 위 D에게 ‘내가 F과 사귈 때는 F더러 나이가 많다고 영감이라고 하더니, 이젠 니가 F과 함께 술 마시고 있냐, 씨발년아’라고 욕설하며 양손으로 위 D의 머리를 붙잡아 바닥에 3회 내리찍고 그 곳 테이블 위에 있던 위험한 물건인 빈 맥주병을 집어 들어 맥주병이 깨져 산산조각 날 정도로 D의 머리를 1회 강하게 내리치고, 또 다시 위험한 물건인 다른 빈 맥주병을 집어 들어 이를 말리던 피해자 F의 머리를 1회 내리쳐, 피해자 D에게 약 14일간의 치료가 필요한 두피열상 및 타박상 등의 상해를 가하고, 피해자 F에게 약 14일간의 치료가 필요한 안면부(좌측이마) 타박상을 가하였다.
