A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. A person who violates the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in the operation of Category B Lone Star.

On December 1, 2019, at around 17:13, the Defendant driven a fluorous vehicle with the blood alcohol concentration of 0.117%, while under the influence of alcohol at around 0.17%, and led directly to a fluorous local highway of the Gyeong-gun, Gyeongnam-gun, Gyeongnam-do, in the side of the mouth, from the fluoral surface to the fluoral surface.

At the time, there was a center line of yellow solid lines at that time and at that place, so there was a duty of care to accurately operate steering the steering wheel and brakes under the influence of alcohol for those engaged in driving of motor vehicles, and to safely drive them by complying with the tea line.

Nevertheless, the Defendant neglected to do so, while driving a yellow cell line with the center line under the influence of alcohol, and received the full part of the victim C(M64 years old) driving DM6 car as the front part of the above knife vehicle at the victim C(M64 years old) driving.

As a result, the Defendant suffered injury to the above victim due to the above occupational negligence, such as a elbow bones, which requires medical treatment for about 12 weeks, and suffered injury to the victim E (V, 65 years old) who was accompanied by the damaged vehicle, including a f5-day therapy, for about seven weeks of age.

2. On June 15, 2012, the Defendant issued a summary order of a fine of two million won for a violation of the Road Traffic Act at the Daegu District Court Kimcheon-do branch on June 15, 2012.

Although the Defendant had been punished for drunk driving as above, the Defendant was driving the said Bone Star car under the influence of alcohol level of about 0.117% from approximately 6 km to G from the date of temporary border as described in paragraph (1) to the Gyeong-gun of the Gyeongbuk-gun of the Republic of Korea.
