Reasons
Punishment of the crime
[2014 Highest 3960] Defendant was sentenced to four months of imprisonment for larceny, etc. at the Daejeon District Court on April 16, 2014 and completed the execution of the sentence on August 17, 2014 in the Daejeon Prison.
On November 6, 2014, at around 23:05, the Defendant: (a) opened and intruded into a e-cafeteria operated by the victim D in Daejeon Dong-gu, Daejeon; and (b) cut off 500 won (4,50 won-compact 100 won-compact 2) which was the victim’s possession in the swine storage place.
[2014Kadan4161] On April 21, 200, the Defendant was sentenced to three years of imprisonment with prison labor for special larceny, etc. on April 21, 200, and on October 14, 2008, the Seoul Northern District Court issued a summary order of 500,000 won as a fine for larceny. On October 29, 2013, the Defendant was issued a summary order of 1,00,000 won as a fine for larceny, etc. at the Youngju District Court’s Young-dong Branch, which was sentenced to six months of imprisonment with prison labor for larceny, etc. at the Daejeon District Court on December 6, 2013, and on April 16, 2014, the execution of the sentence was terminated at the Daejeon Prison on August 16, 2014.
On November 9, 2014, the Defendant came to “H kindergarten” operated by the Victim G from Daejeon Dong-gu, Daejeon on November 9, 2014, which was operated by the Victim G, and then intruded into the “H kindergarten,” through a creshed main window by using a cresh of nearby surveillance, and then does not have any stolen objects, but did not commit an attempted crime by checking that CCTV was installed inside and out of the inside, and having confirmed that the CCTV was installed.
In addition, from Sep. 2014 to the above temporary date, the Defendant habitually attempted to steals property or steals property equivalent to KRW 952,00,000, totaled eight times, as stated in the list of crimes committed in the attached Table.
