Punishment of the crime

【The Defendant was sentenced to a suspended sentence of ten months for fraud, etc. at the Seoul Western District Court on May 26, 2017. On August 18, 2017, the Defendant was sentenced to a four-month imprisonment with prison labor for intrusion buildings at night at Seoul Western District Court on August 26, 2017, and the said sentence became final and conclusive on August 26, 2017, and the execution of the final sentence was completed on August 6, 2018.

[Criminal Facts]

1. Larceny;

A. On August 9, 2018, at around 18:47, the Defendant: (a) calculated the Victim Ekwitter in Seoul Mapo-gu and the second floor “DPC car page”; (b) held a juvenile card 1, T money transportation card 1, and a smartphone 50,000 won, which includes approximately KRW 50,000,000,000, on the computer books used by the victim.

B. On August 13, 2018, at around 22:00, the Defendant lost the Victim F from the “DPC car page”, and went through the Defendant’s supervision over the Defendant’s employees by neglecting the supervision over the Plaintiff’s employees, since the Plaintiff’s Kakak Bank (Debit) card (Debit card) owned by the victim, 1,000 won in cash, and 1,50,000 won in the market price consisting of 1,50,000 won in the container 4.

Accordingly, the defendant stolen the victims' property twice.

2. Violation of Acts in financial business specializing in fraud and credit;

A. On August 13, 2018, the Defendant purchased an electronic tobacco amounting to KRW 9,000 from H convenience store in Seodaemun-gu Seoul, Seoul around 22:45, and caused the victim to pay the 2A payment of the said electronic tobacco by presenting the F's Kaka-bank bank card (Debit card) that was stolen, as provided in paragraph 1-b, to the victim as if he/she had legitimate right to use the 1-B.

As a result, the defendant uses the stolen physical card (debit card) and then 2 A of electronic tobacco amounting to KRW 9,000 of the market price from the injured party.
