Punishment of the crime

【Defendant A’s intent to offer and deliver passbooks and cards to be used for the crime of telephone financial fraud(scam) from a person who is in China, and Defendant A intended to offer money from a person who is not in China. Defendant B and Defendant B to offer and deliver passbooks and cards to be used for the crime, and to impose money.

【범죄 사실】 보이스피싱 범죄는 통상적으로 중국 조직과 국내 조직이 점조직으로 연결되어 전화 또는 카카오톡, 위쳇 등 SNS 메시지로 서로 연락하여 각 역할을 분담하면서, 먼저 불특정 다수인에게 메시지를 보내는 콜센터 조직, 통장이나 카드 등 속칭 대포통장을 모집ㆍ편취ㆍ운반하는 조직, 그 카드 등을 교부받아 이를 바탕으로 현금을 인출하는 인출조직 등으로 구성되어 있다.

1. 피고인들의 공동범행 피고인들은 중국 불상지에 거주하는 위쳇 대화명 D를 사용하는 성명불상자의 지시를 받아 일일 40만 원을 받는 조건으로 전화사기 범행 도구인 통장, 카드를 전달 받아 불상의 공범들에게 다시 전달해 주기로 하였다.
