The part against the Defendants is reversed.

A Imprisonment with prison labor for one year, and Defendant B for eight months.

1. Summary of grounds for appeal;

A. Defendants 1) misunderstanding of facts and misunderstanding of legal principles, Defendants merely received hospitalized treatment necessary for the treatment of each term disease, and hospitalized according to medical judgment’s instructions, and there was no deception of the victimized insurance company.

B) As search and seizure by the police is detrimental to the nature of warrant requirement, medical records, details of credit card use, etc. constitute illegally collected evidence, and the data analyzing illegally collected medical records and the legal testimony of the nurse who analyzed them are all derived from the illegally collected evidence, and thus, it is inadmissible.

2) Each sentence of the lower court (Defendant A: 1 year of imprisonment with prison labor; Defendant B: 10 months of imprisonment) against the illegal Defendants is too unreasonable.

B. Each sentence of the lower court against the Defendants by the Prosecutor is too unhued and unreasonable.

A.
