As to the crimes under paragraph (1) of the same Article, the defendant is punished by a fine of 2,00,000 won and the crimes under paragraph (2) of the same Article.

Criminal facts

On November 13, 2013, the Defendant was sentenced to two years of suspended sentence for embezzlement, etc. at the Seoul Central District Court on October 10, 2013 and the judgment became final and conclusive on November 13, 2014.

The Defendant, who was in office as the president of the E affiliated with the D University (hereinafter “E”), was a person who was in office as the professor of the University E (hereinafter “the instant E”). In the instant case E, the Defendant: (a) recruited foreign students of nationality, such as the steel frame and Vietnam, to complete the Korean language language training in the instant E; and (b) provided convenience in the extension of the student’s stay period.

1. No person who violates the Immigration Control Act shall invite an alien by fraudulent means, such as making a false entry of the alien or providing a false reference, or arrange such invitation, in order to allow the alien to enter the Republic of Korea;

However, the Defendant, under the name of the representative G of the “Social Welfare Foundation F,” which is not easy to attract foreign students who want to complete the language training course of the instant E, entered the Republic of Korea by inviting foreign students to the seminars for the global leader training program. The Defendant, upon receiving a copy of the business registration certificate of the Social Welfare Foundation F from G around September 2013, the Defendant filed a false invitation with the Defendant to the effect that the instant employee would enter the Korean language training course, and then submit an application for a visa to the Republic of Korea by 10 days from the date on which he/she completed the schedule to 30 days from the date on which he/she submitted the visa to 20 days from the date on which he/she applied for the visa issuance to the Republic of Korea.
