A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
On February 15, 2003, the Defendant was sentenced to imprisonment for a violation of the Punishment of Violences, etc. Act at the Cheongju District Court on February 15, 2003, and was released on August 14, 2004 and passed on November 9, 2004 during the execution of the sentence.
The defendant, in the course of the People's Republic of China, has attempted to acquire money from Chinese people, focusing on the ship's houses, for the recruitment of industrial trainees under the employment conditions of the modern middle industry, and received money under the following employment fees.
On October 19, 2006, the Defendant made a false statement to the above D at the office of study department located in C department stores in the People's Republic of China, stating that “The head of the division belonging to B of the Hyundai Heavy Industries Coordination and Coordination Office is in charge of recruiting industrial trainees. The Defendant selected the two thousands to 3,000 bills per capita through departure fees, etc. as a major industrial trainee, and then selected the industrial trainee to be employed in the modern Heavy Industries, and then selected the industrial trainee to be employed in the modern Heavy Industries.”
However, even if the defendant did not receive the money from industrial trainees who do not belong to the Hyundai Heavy Industries, he did not have the intention or ability to employ them in the Hyundai Heavy Industries.
From around that time to January 31, 2008, the Defendant received the total amount of KRW 162,176,000 from 30 victims, such as victims E, to D through D, in total, 52 times as shown in the attached list of crimes.
Accordingly, the defendant, by deceiving the victims, acquired financial benefits of 162,176,00 won in total.
