The defendant shall be innocent.
Reasons
No person, other than an attorney-at-law in a public lawsuit, shall receive or promise to receive money, valuables, entertainment or other benefits, and handle legal affairs, such as preparation of legal documents, in relation to litigation cases, non-contentious cases, litigation cases, adjudication cases or other general legal cases.
The Defendant was a person who was working as a leader of the D fishing village fraternity located in the Si of Si from around 2004 to June 11, 2012.
On September 30, 2010, the Defendant, from the owners of 130 fishing vessels belonging to the above fishing village fraternity, agreed to receive 4% of the compensation from the owners of the above fishing village fraternity in return for the compensation for "fishery damage caused by anchorage, expansion, maintenance and dredging of ocean route" and "fishery damage caused by the construction of loading and unloading facilities and drainage pipes, and the installation of pumps," which are promoted by the Korea Coast Guard, was promoted by the Korea Coast Guard and the Korea Coast Guard. The Defendant performed the business related to the payment of compensation, such as the designation of the damaged fishery service company, the vicarious issuance of documents necessary for the application for compensation, consultation related to the right to compensation, etc. from around that time.
When the Defendant paid a total of KRW 457,398,50 to the owners of 130 fishing vessels belonging to the said fishing village fraternity a total of KRW 826,319,00,00 for the compensation of the Daesan Regional Maritime Affairs and Port Authority and the compensation of the Pyeongyang Port Authority, the Defendant received KRW 240,00 from the Triju river labor union around December 8, 201, and received KRW 32,185,390 in total over 145 times from around that time to July 10, 2012 as indicated in the attached Table of Crimes.
As a result, the defendant was not a lawyer and received money in return for handling legal affairs of other general legal cases.
