2. 공무집행방해 피고인은 위 1항 기재일시, 장소에서 위 1항 기재와 같은 사유로 신고를 받고 출동한 강릉경찰서 G지구대 소속 경찰관인 피해자 경사 H(48세)가 식당 업주의 신고 경위 및 현장 상황을 확인한 후, 피고인을 업무방해 혐의로 현행범인 체포를 하자 화가 나, “야, 씹 새끼야, 모가지를 잘라 버리겠다, 비켜 새끼야, 확 죽여 버리기 전에”라고 욕설을 하며 오른발로 피해자의 좌측 정강이를 4회 걷어차고, 피해자가 수갑을 채우려고하자 재차 “야, 개새끼야, 비켜 죽여 버리기 전에”라고 욕설을 하며 오른발로 피해자의 좌측 정강이를 2회 걷어찼다....
