1. Defendant A shall be punished by imprisonment with prison labor for one year.

However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. ” 고 말하며 피해자와 말다툼을 하고, 피해자와 함께 엘리베이터를 타고 위 모텔 1 층 주차장 앞으로 내려와 피해자에게 “ 복싱, 복싱” 이라고 말하고 주먹으로 때리는 시늉을 하며 시비를 걸고, 이에 피해자가 112에 신고를 하자 피고인들의 일행인 H이 운전하는 I 매그 너스 승용차를 타고 그곳을 벗어나려고 하였으나 피해 자가 위 승용차 조수석 문을 잡으며 제지하자 화가 나, 피고인 A은 양손으로 피해자의 가슴 부위를 2회 밀치고 주먹으로 피해자의 얼굴을 1회 때리고, 이어서 피고인 B는 미리 가지고 있던 위험한 물건인 손 칼( 전체 길이 약 16cm, 칼날 길이 약 7cm) 로 피해자의 오른쪽 배 부위를 강하게 1회 찌르고, 계속하여 피고인들은 주먹으로 피해자의 얼굴, 몸통 등 온몸을 수회 때렸다.
